Welcome to GameFeeder. These Terms of Use ("Terms") govern your access to and use of the GameFeeder mobile application and the website at gamefeeder.app (collectively, the "Service").

By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use GameFeeder.

1. Eligibility

You must be at least 18 years of age to use GameFeeder. By creating an account, you confirm that you are 18 or older. If we learn that a user is under 18, we will terminate their account and delete associated data immediately.

You must have the legal capacity to enter into a binding agreement and must not be prohibited from using the Service under the laws of your jurisdiction.

2. Account Registration and Security

To access most features of GameFeeder, you must create an account. You agree to:

• Provide accurate, current, and complete information when registering.
• Keep your login credentials confidential and not share your account with anyone else.
• Notify us immediately if you suspect unauthorized access to your account at contact@gamefeeder.app.
• Be solely responsible for all activity that occurs under your account.

You may not create an account on behalf of someone else, impersonate any person, or use a name or likeness you are not authorized to use.

3. User Content

3.1 Your Content, Your Ownership

GameFeeder allows you to post photos, videos, captions, harvest data, and other material ("User Content"). You retain ownership of your User Content.

3.2 License You Grant Us

By posting User Content, you grant GameFeeder a worldwide, non-exclusive, royalty-free, sublicensable license to use, display, reproduce, distribute, and create derivative works of your User Content solely to operate, maintain, and promote the Service. This license ends when you delete the content or close your account, subject to reasonable technical propagation delays and the content-retention rules described in our Privacy Policy.

3.3 Content Standards

User Content must not:

• Depict or encourage illegal hunting, poaching, trespassing, or any activity that violates federal, state, tribal, or local wildlife and conservation laws.
• Show the inhumane treatment of animals.
• Contain nudity, sexually explicit material, or graphic violence unrelated to lawful hunting or fishing.
• Harass, bully, threaten, or impersonate any person.
• Constitute hate speech targeting any group based on race, religion, ethnicity, gender, sexual orientation, disability, nationality, or other protected characteristic.
• Constitute spam, unsolicited advertising, or pyramid/MLM schemes.
• Infringe the intellectual property, privacy, or publicity rights of any third party.
• Contain malware, viruses, or other malicious code.
• Include false or misleading information presented as fact.

3.4 Content Moderation

We reserve the right — but not the obligation — to review, remove, or disable access to any User Content that we believe violates these Terms or is otherwise harmful, at our sole discretion and without prior notice. Removal of content does not create liability on our part.

4. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
• Scrape, crawl, index, or harvest data from the Service without our express written permission.
• Attempt to gain unauthorized access to any part of the Service, another user's account, or our servers or networks.
• Interfere with or disrupt the integrity, performance, or security of the Service.
• Create fake or duplicate accounts or misrepresent your identity or affiliation.
• Reverse-engineer, decompile, or disassemble any part of the Service.
• Use the Service to solicit, recruit, or facilitate illegal hunting, poaching, or wildlife trafficking.
• Use automated tools (bots, scripts) to interact with the Service without our written consent.

5. Privacy and Location

Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference. You acknowledge that:

• Location access is opt-in. We access your GPS only if you explicitly choose "Use my location" during post creation. We never request location in the background.
• Exact coordinates are private. Your GPS data is never shared publicly. All public map views display only a fuzzed, approximate area.
• You may always use a manual map pin to set a location without sharing GPS data.

6. Intellectual Property

All content, design, software, graphics, logos, trademarks, and other elements of the Service (excluding User Content) are owned by or licensed to GameFeeder and are protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you any right to use GameFeeder's trademarks, logos, or branding without our express written permission.

7. Third-Party Services and Links

The Service may contain links to or integrate with third-party websites, services, or content that we do not control. We are not responsible for the privacy practices, terms, content, or availability of those third-party services. Your use of them is at your own risk and subject to their terms.

8. Age-Gating and Regulated Activities

Hunting and fishing are regulated activities. By using the Service, you represent that you will comply with all applicable federal, state, and local laws and regulations governing hunting and fishing in your jurisdiction, including holding required licenses and tags. GameFeeder is a social platform and does not facilitate the purchase of licenses or ensure legal compliance on your behalf.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, GAMEFEEDER DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF CONTENT.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, GAMEFEEDER AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE — INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL — EVEN IF GAMEFEEDER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED US DOLLARS ($100).

11. Indemnification

You agree to defend, indemnify, and hold harmless GameFeeder and its officers, directors, employees, affiliates, and agents from and against any claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your use of or access to the Service;
• Your User Content;
• Your violation of these Terms; or
• Your violation of any third party's rights, including intellectual property or privacy rights.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason — including if we believe you have violated these Terms. You may delete your account at any time from within the app settings.

Upon termination for any reason, your license to use the Service ends immediately. Sections 3.2, 6, 9, 10, 11, 13, and 14 survive termination.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Ohio, United States, without regard to its conflict-of-law principles.

Informal resolution: Before initiating any formal dispute, you agree to contact us at legal@gamefeeder.app and give us 30 days to attempt to resolve the dispute informally.

Arbitration: If informal resolution fails, any dispute, claim, or controversy arising from or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration shall take place in Ohio, and judgment on the award may be entered in any court of competent jurisdiction. Either party may seek injunctive or other equitable relief in a court of competent jurisdiction without waiving the right to arbitrate other claims.

Class action waiver: You waive any right to participate in a class action lawsuit or class-wide arbitration relating to the Service.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you via the app or by email to the address associated with your account at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes your acceptance of the revised Terms.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and GameFeeder regarding the Service and supersede all prior and contemporaneous agreements and understandings, whether written or oral, relating to the Service.

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in full force and effect.
